Picturesports.co.uk LICENSING TERMS & CONDITIONS

END-USER LICENSE AGREEMENT (EULA) By downloading any image or material from our website, you hereby agree to the following terms and conditions as outlined herein, and as listed elsewhere on our website:

This agreement is made by and between Picturesports.co.uk and the clients and users of our service (otherwise listed herein as You or Your). Picturesports.co.uk hereby represents that it owns all rights and copyrights to all materials on our website or is authorised to represent the copyright holder in this trasaction and all rights and copyrights to said website and materials shall remain the exclusive property, right and control of and under Picturesports.co.uk and "Materials" from our website will constitute and be defined as any photo, image, design, or layout represented on the Picturesports.co.uk website. By downloading any Materials from Picturesports.co.uk you are asserting your declaration that you have read, understood, and agreed to all terms and conditions listed in this Agreement, and otherwise identified on our website.

You understand and agree that Picturesports.co.uk may, in its sole discretion:

Monitor your download activity from Picturesports.co.uk as often as Picturesports.co.uk determines under its sole discretion for any reason and for any violation of this Agreement.
Disable any account that engages in what Picturesports.co.uk determines to be a large number of photos on any given day, as such activity indicates possible EULA violations or abuse of a username/password and account.
Investigate any abuse of your username and password in connection with the Picturesports.co.uk website or in connection with this Agreement.
Take the appropriate action to investigate all potential abuse, which can lead to contacting the individual involved with the violations, account suspension, account termination, or other actions deemed necessary depending on the nature and severity of the violations, if we are unable to confirm the validity of the activity.
Terminate your account immediately for any violation of this agreement, or the Terms and Conditions as defined in this Agreement and elsewhere on Picturesports.co.uk, without notice. If your account is terminated for any violation of this Agreement and/or abuse of your username or password, and/or our Materials, you lose all rights to Picturesports.co.uk Materials, and you must IMMEDIATELY delete any and all Materials obtained prior to this termination, and forfeit all fees paid.

Commissioning Rule:
It hereby agreed by all parties that the copyright to all images taken either on an ad-hoc or commissioned basis shall at all time resides with Picturesports.co.uk or the associated photographer. Where commissioned work is undertaken the license given herein shall apply and the copyright retained by Picturesports.co.uk Neither the photographer nor Picturesports.co.uk accept commissions to create copyright works other than to agree to license such parts of the works selected by the photographer or Picturesports.co.uk for presentation to the Client.

Copyright:
All images (including thumbnails) on this site are Copyright © Picturesports.co.uk or our associated photographers. Under the copyright law the images may only be downloaded, and published in any media, including printed or electronic, in agreement with the terms given herein.

License:
At purchase you are granted a non-exclusive licence to the image(s) that you have chosen and their use is limited to private and personal use which expressly EXCLUDES the media in any form including but not limited to newspapers, magazines, commercial brochures, multimedia presentations, clothing, exhibition panels, videos and adverts, promotional material of any kind, placement on any on-line service specifically designed to offer images for viewing or downloading as an image library, usage on the cover of a book, music or software packaging, re-selling, loan, hire or 'give-away' through any method that would give the recipient these images in digital format, used as a postcard or poster, included in any other Photo or Clipart collection, included in any other image library unless the use has been agreed by us in writting. At all times the use of any of our images in an obscene, offensive or litigious manner is stickly prohibited.

Terms and Conditions of Sale & Licence Agreement:
Our terms and conditions are here to simply protect and maintain our image collection from piracy and misuse. The use of any of our images in whatever format indicates your acceptance of this Licence Agreement.

Art Credits:
The licensee is obliged to credit Picturesports.co.uk with the public use of the images.

Warranty:
Picturesports.co.uk does not make any warranties of any kind either express or implied as to the merchantability or suitability of this product for any purpose. Picturesports.co.uk make no warranties as to the type or quality of any image or compatibility with any computer or other kind of equipment.

Neither Picturesports.co.uk or any of their directors, officers, employees, partners, agents or any other person shall be liable for any damages, whether direct, indirect, consequential or incidental, arising out of the use of, or inability to use this product.

Picturesports.co.uk or our associated photographers own the copyright of the image and grants you, the purchaser a non-exclusive, non-transferable licence to use the image for your personal and private use upon receipt of full payment for the images.

All of the images remain the property of Picturesports.co.uk

Use of this Site:
Although we endeavour to ensure the accuracy of the information placed on this web site we do not warrant or guarantee the accuracy or correctness of such information or of any other content, description or material placed on or referred to on this web site. We do not warrant that the web site, its content or the server that makes it available are error or virus free or free of other harmful components or that your use of this web site will be uninterrupted.

In no event will we be liable for any loss or damage (whether direct or indirect, including loss of profits or any consequential loss) resulting from or in any way connected with your use of this web site whether caused by negligence or otherwise.
